Terms & Conditions
The Anniversary Present is a trading name of Anniversaire Ltd (Co No. 5972414).
These terms and conditions apply to all transactions between us where we agree in writing to vary them
1. Orders
Order acceptance and the completion of the contract between you and Anniversaire Ltd will take place on the despatch of the products ordered by you, unless we have notified you that we will not be able to accept your order or you have cancelled it in accordance with the instructions.
If for any reason your credit card details are incorrect or there is not enough money in your account or for any other reason the order cannot be processed, Anniversaire Ltd will have right to refuse the sale and upon their decision to do so, the order will be cancelled.
We reserve the right to reject any offer to purchase by you at any time. We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure but, in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.
2. Contract Cancellation
Please note that you are entitled to cancel this contract if you so wish provided you exercise your right no longer than eight working days after the day on which you receive the products.
If you wish to exercise your right to cancel this contract before order dispatch you must do so in writing or by e-mail. If your order has already been despatched then please follow the procedure set out in Policy & Returns.
3. Description of Products
Each product purchased is sold subject to its Product Description. We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the Website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the Website as up to date as possible, the information, including Product Descriptions, appearing on this Website at a particular time may not always reflect the position at the exact moment you place an order.
4. Returns Policy
If you wish to return any items purchased online you must follow these steps:

If you wish to return an item, you must notify your intention to return it, in writing, within 7 working days from the date you received your goods. The item(s) must then be returned within 14 days of invoice date |

All items must be returned in unused (re-saleable) condition in original packaging. |

Subject to the above you are entitled to a refund within 30 days of returning your item. |

You are responsible for postage costs incurred when returning an item. Goods must be returned with proof of purchase by Registered Post only. We will not be responsible for any item returned to us in any other way. |

In the case of faulty or damaged goods you must notify us in writing within 24 hours of receipt and we will refund you the cost of the postage on return of the goods |

5. Alcoholic Merchandise
We may sell products containing intoxicating liquor. For clarity, a drink containing alcohol is classified as intoxicating, if it contains more than 0.5% of alcohol by volume (0.5% abv). Pursuant to the Licensing Act 1964 it is an offence for any person under the age of 18 to buy, or attempt to buy, intoxicating liquor, or for any person over the age of 18 to buy intoxicating liquor on behalf of any person under the age of 18, subject to a maximum fine on conviction of £1000.
In accepting these Conditions you agree to provide Anniversaire Ltd truthful and accurate information and act in accordance with the Licensing Act of 1964.
6. Payment
All prices are inclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system. The total cost of your order is the price of the products ordered plus delivery.
You confirm that the credit or debit card that is being used is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.
7. Refusal of Transaction
We reserve the right to withdraw any products from this Website at any time and/or remove or edit any materials or content on this Website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from this Website whether or not that product has been sold; removing or editing any materials or content on the Website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.
To be eligible to purchase products on this Website and lawfully enter into and form contracts on this Website under English law you must:
Register by providing your real name, phone number, e-mail address, payment details and other requested information
Be over 18 years of age
Stipulate a delivery address in the United Kingdom. Please note that PO box numbers, hotels and accommodation addresses are not acceptable
Possess a valid credit or debit card issued by a bank acceptable to us
By making an offer to buy a product, you specifically authorise us to transmit information (including any updated information) or to obtain information about you from third parties from time to time, including but not limited to, your debit or credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.
8. Site Content and Weblog
a) Users of The Anniversary Present may post weblog entries as long as the content is not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties and does not contain any form of commercial solicitation, chain letters, mass mailings, or any form of "spam." You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of any content. Anniversaire Ltd reserves the right (but not the obligation) to remove or edit any content.
b) If you do post content or submit material on the weblog, you grant Anniversaire Ltd a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant Anniversaire Ltd and its sub-licensees the right to use (or choose not to use) the name that you submit in connection with such content.
c) You may only post content to this website which you own the rights to, which is accurate, and which does not cause injury to any person or entity. You agree to indemnify Anniversaire Ltd for all claims brought by a third party against Anniversaire Ltd in connection with content which you post.
d) The intellectual property in these pages is our absolute property and no part of it may be used other than for the exclusive purpose of using this website or placing an order with us

We may choose from time to time to provide links to various third-party websites from the Website. This may include links to sites owned by our associated companies. These third-party links are provided for your convenience only and are accessed at your own risk. You agree that we have no responsibility or liability for any independent policies or actions of these third-party sites and are not responsible in any way for the privacy practices, customer service practices, content or availability of any such websites. You also agree that we shall not be responsible in any way for any damage or loss caused in relation to the content, goods or services available through such websites.
10. Promotional Vouchers
Promotional Gift Vouchers can only be used online at The Anniversary Present.com
Promotional Gift Vouchers have a cash redemption value of 0.001p.
Only one promotional gift voucher may be used per order.
11. Liability
To the maximum extent permitted by law, all representations, warranties, terms, conditions and commitments not expressly set out in these Terms are hereby excluded.
Except in the case of death or personal injury caused by our negligence, or fraud, we do not accept responsibility for any loss or damage that you suffer as a result of using the Website. In particular, we do not accept responsibility for (a) any loss of profits, loss of anticipated savings, loss of goodwill or loss of revenue; (b) any loss or corruption of data; or (c) any indirect or consequential loss. Our liability is limited to the purchase price of the product purchased
12. Delivery
We will endeavour to meet your requirements regarding time and place of delivery but accept no responsibility for any delay or other factor outside our control. It is your responsibility to ensure that any delivery address is available to the carrier or postal service which we use or any requirements of that carrier or postal services for the acceptance of goods delivered (for example where a signature is required)
